Terms of Service
These terms are the deal between you and FlemTech LLC ("we," "us"), which runs INsperience. By creating an account or using the app, you agree to them. They're written to be read, so please do.
1. Who can use INsperience
- You must be 13 or older to create an account. If you're under 18, you need a parent or guardian's permission, and they agree to these terms on your behalf.
- One person per account. Keep access to your email secure: anyone who can read it can sign in as you.
- You can't use INsperience if we've previously removed your account, or if the law where you live doesn't allow it.
2. Not affiliated with In-N-Out
INsperience is an independent fan project. It is not affiliated with, endorsed by, or sponsored by In-N-Out Burgers. "In-N-Out" and related names are trademarks of In-N-Out Burgers, used here only to identify the restaurants. Store details may be out of date. Check with the restaurant before you make the drive.
3. Your posts
- You own what you post. By posting, you give us a worldwide, non-exclusive, royalty-free license to host, store, display and distribute it in and around INsperience (in feeds, on profiles, on the leaderboard and in promoting the app). The license ends when you delete the post or your account, except for copies already shared or kept as required by law.
- Only post photos you took or have the right to share.
- Posts are tied to the store where you were verified. Your username, posts, photos, captions and stats are public to other users.
4. The rules
INsperience is for sharing In-N-Out visits. We have zero tolerance for objectionable content or abusive users. Don't post or do any of the following:
- Harassment, bullying, threats, or hate based on who someone is.
- Nudity, sexual content, graphic violence, or anything illegal.
- Spam, scams, advertising, or anything unrelated to In-N-Out.
- Faking your location, spoofing GPS, or otherwise gaming the geofence, milestones or leaderboard.
- Impersonating someone, or posting someone else's private information.
- Content that infringes someone's copyright, trademark or other rights.
- Scraping the service, interfering with it, or trying to get around our security or limits.
5. Reporting, blocking and enforcement
- Tap ⋯ on any post or profile to report it or block the account. Blocking hides each of you from the other.
- We review reports promptly, usually within 24 hours. We may remove any content and suspend or delete any account that breaks these rules, with or without notice.
- Think we got it wrong? Email [email protected].
6. Copyright complaints
If you believe something on INsperience infringes your copyright, email [email protected] with what was copied, where it appears in the app, your contact details, and a statement that you're the owner (or authorized to act for them) and that the complaint is made in good faith. We'll remove infringing content and may remove the accounts of repeat infringers.
7. Deleting your account
You can delete your account any time: in the app, open the account menu and tap Delete account, or see insperience.app/delete-account. Deleting removes your posts, photos, stats, follows and blocks. We may also end your access if you break these terms.
8. The service, as is
INsperience is a free fan project provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't promise it'll always be up, error-free, or that location verification or store details are accurate. We may change, pause or end any part of it.
9. Limitation of liability
To the extent the law allows, FlemTech LLC won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of INsperience. Our total liability for any claim is limited to $50. Some places don't allow these limits, so they may not all apply to you.
10. Changes and the law
We may update these terms. If a change is material, we'll update the date above and let you know in the app; continuing to use INsperience means you accept the new terms. These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
